TRUCARE PAIN MANAGEMENT, LLC
NOTICE OF PRIVACY PRACTICES
Document ID: ADM-P003
Effective Date: November 1, 2026
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
PURPOSE
This notice explains how TruCare Pain Management, LLC ("TruCare") uses and shares your protected health information, your privacy rights, and our legal duties.
OUR LEGAL DUTIES
We must protect the privacy of your health information, provide this notice, follow the notice currently in effect, and notify you following a breach of unsecured health information when required by law.
We may change this notice and apply the changes to all health information we maintain. Revised notices will be posted prominently in our office and at www.trucarepm.com. Copies are available at our office or from our privacy contact.
HOW WE MAY USE AND DISCLOSE YOUR INFORMATION
The following uses and disclosures are subject to applicable law and the additional confidentiality protections below.
Treatment. We may use and share information to provide and coordinate your care. For example, we may share information with a treating provider, pharmacy, laboratory, or specialist.
Payment. We may use and share information to obtain payment for your care. For example, we may send your health plan information needed to process a claim.
Healthcare operations. We may use and share information to run our practice and improve care. For example, we may review medical records to evaluate quality or train staff.
Care communications. We may contact you about appointments, prescriptions, referrals, and other treatment-related matters.
Business associates. We may share information with service providers, such as billing or technology companies, that must protect it under applicable agreements and law.
People involved in your care. We may share relevant information with people involved in your care or payment if you agree or have an opportunity to object and do not. If you cannot express a preference, we may share information in your best interests as permitted by law. We may also share limited information for notifications about your location, general condition, or death and for authorized disaster relief.
Other legally permitted or required purposes. Subject to the conditions and safeguards required by law, we may share information for:
Public health reporting and health oversight, including audits, inspections, and licensing.
Reporting abuse, neglect, or domestic violence.
Helping someone able to prevent or lessen a serious and imminent threat to health or safety.
Law enforcement and court or administrative proceedings. A subpoena alone does not automatically authorize disclosure.
Workers' compensation.
Coroners, medical examiners, funeral directors, and organ or tissue donation.
Authorized military, national security, protective services, and correctional-custody functions.
Research, including when an approved waiver or another legal research exception permits use or disclosure without authorization.
We will disclose information when applicable law requires it, including to the U.S. Department of Health and Human Services when required to review our compliance.
ADDITIONAL CONFIDENTIALITY PROTECTIONS
Oklahoma protections. Some mental-health and substance-use treatment information, including records received from other providers, may have additional protection under Oklahoma law. When 43A O.S. § 1-109 applies, we disclose that information only with valid authorization, an appropriate court order, or another applicable statutory exception. A subpoena alone is insufficient. We follow applicable laws that provide greater privacy protection.
Federally protected substance-use treatment records. If we receive records protected by 42 CFR Part 2, we follow the requirements applicable to those records. Such records, or testimony describing their contents, may not be used or disclosed in civil, criminal, administrative, or legislative investigations or proceedings against you without your specific written consent or a qualifying court order. Consent for a proceeding must be separate from consent for other purposes. The court-order process requires notice and an opportunity to be heard for you or the record holder, as applicable. Before the requested record is used or disclosed under that order, a subpoena or other legal requirement compelling disclosure is also required.
USES AND DISCLOSURES REQUIRING WRITTEN AUTHORIZATION
Most uses and disclosures of psychotherapy notes, most marketing uses and disclosures, and the sale of your health information require your written authorization. For uses and disclosures outside those described in this notice, we will obtain your written authorization.
You may revoke an authorization by writing to our privacy contact. Revocation does not undo actions already taken in reliance on your authorization.
TruCare does not use patient health information for fundraising.
YOUR RIGHTS
Contact our privacy contact below to exercise these rights. We may require certain requests in writing and can provide forms or explain the process.
Inspect or receive a copy. You may request to inspect or receive a copy of information in your medical and billing records and other records used to make decisions about you, including an electronic copy when applicable. We may charge a reasonable, cost-based fee when permitted by law. Access may be denied only as allowed by law.
Request an amendment. You may ask us in writing to correct information you believe is incorrect or incomplete. If we deny your request, we will explain why in writing and how to submit a statement of disagreement.
Request an accounting. You may request a list of certain disclosures of your information. The law excludes some disclosures, including many for treatment, payment, and healthcare operations.
Request restrictions. You may ask us to limit certain uses or disclosures. We generally do not have to agree. However, if you or someone other than your health plan pays us in full for an item or service, we must honor your request not to disclose information pertaining solely to that item or service to your health plan for payment or healthcare operations, unless disclosure is required by law.
Request confidential communications. You may ask us to contact you in a particular way or at a particular location. We will accommodate reasonable requests as required by law.
Receive a paper notice. You may request a paper copy of this notice at any time, even if you agreed to receive it electronically.
Receive breach notification. We will notify you following a breach of unsecured health information when required by law.
Use a personal representative. Someone with legal authority to act for you may exercise your rights as permitted by law. We may verify that authority.
File a complaint. If you believe your privacy rights were violated, call our privacy contact or send her a written complaint at the address below. You may also complain to the U.S. Department of Health and Human Services, Office for Civil Rights, at www.hhs.gov/hipaa/filing-a-complaint. We will not retaliate against you for filing a complaint.
